Shelter from the Storm: How a COVID Mortgage Meltdown was Averted

Session Overview: The COVID-19 pandemic upended our daily lives and transformed the political landscape. The crisis was not only an unprecedented shock to our healthcare system but also an unprecedented threat to our economic well-being, including the mortgage and housing markets.

While the primary focus of the federal response was appropriately on public health, a critical aspect of that response was the efforts to keep families in their homes. Despite the reforms following the 2008 financial crisis, our financial markets were not prepared, but some were determined not to repeat the many mistakes of 2008.

As director of the Federal Housing Finance Agency
(FHFA), which oversees Fannie Mae, Freddie Mac, and the Federal Home Loan Banks, Mark Calabria was responsible for leading that response. In Shelter from the Storm, he tells the story of how millions of families were provided mortgage and rental assistance both to keep them safe and to keep our financial markets functioning. He offers readers a peek behind the curtain of government decision-making in a crisis.

​Calabria will also share insights and anecdotes from his service at the White House, as Chief Economist to Vice President Pence.

  • A Periodic Statement is considered an attempt to collect a debt if:
    • If the statement contains language stating “this is an attempt to collect a debt”

    • The statement provides for a late fee if the payment is not made on time, and
    • The history between the parties suggests that the statement is an attempt to collect on a disputed debt.  
  • In the Dean case, the statement was determined to not be an attempt to collect a debt because there was not a threat of late fees and there was a clear statement that this was for informational and compliance purposes only

        • Firms must meet 28 FMRs
        • Servicers must ensure continuous compliance
      • Light touch
      • Try to ensure we engage with every firm in some way during the year
    • Firm Manager Team – resumption of firm visits to conduct performance and fee/cost reviews

      • Attorney presence at most industry conferences; available to meet in person
      • Daily engagement on non-routine litigation

  • Post-pandemic: recruitment and (re-) training:
    • Servicers and law firms have recruited/may recruit employees with no, or limited, experience in mortgage default work.
      • Essential to provide close supervision of inexperienced staff
      • Training should not just be about the procedure or mechanics of moving a file from point A to point B
        • This should include big mistakes that were made and how they are to be avoided, e.g., robo-signing
      • Servicers and firms should provide inexperienced employees a “big picture” view of loan origination, servicing, default servicing, and foreclosure.
      • UCC basics should be ingrained: note endorsement and negotiation, allonges (when to use and not to use), holder status: real party in interest
      • Business records exception to hearsay rule
      • Incorporation of prior servicer records upon servicing transfer
      • Existing employees should be provided re-training.
    • Important for all employees working Fannie/Freddie/VA/HUD files to be familiar with relevant guidelines and directives:
      • E.g., Fannie Mae: Retention Agreement, Schedule of Fees and Costs, AAA Matrix, relevant portions of Selling and Servicing Guides
      • Reporting “non-routine litigation” to Fannie Mae
      • Appropriate oversight by servicers of law firms
  • Retirement of COVID policies/programs/mentality
    • Lessons learned
    • What is the “new normal”
    • Why telework was actually far more productive (hint: 2 hours of commute means 2 hours less work per day)
  • Transfers of servicing
    • Data standardization
    • Bank runs/fails
    • Bigger risk: non-GSIB bank or non-bank?
    • Contraction of industry: will it be minimal or overwhelming
