Hot Topics Session

Focus On: The New Normal, 2022 Edition
The pandemic has, in many ways, reshaped the mortgage default environment. In this session, we will assess and discuss the “new normal” for 2022 as we transition out of the pandemic period. To facilitate this discussion, an esteemed servicer and attorney panel, with audience participation, will explore and discuss practical solutions to clear backlogs and keep files moving while avoiding undue risks and expensive mistakes. This panel will discuss challenges raised by a changing enforcement emphasis at the CFPB, real-world experience with Regulation F, developing post-pandemic case law in various jurisdictions, and the practical challenges associated with returning to “normal” from a relatively low level of default activity. Attendees can anticipate practical and proven techniques for dealing with these and more challenges.

Real-world experience with Regulation F: Best methods to ensure compliance
  • The exception for close-end mortgages: “the most recent periodic statement”
  • HELOCS: the most recent periodic statement plus the outstanding principle as of the statement date
  • Reverse mortgages: the most recent periodic statement plus the outstanding principle as of the statement date
  • Challenges with second mortgages and very old defaults: What is the best choice for “itemization date?”
