Connecting the dots on hot topics, emergent issues, and their impact on the mortgage servicing industry

USFN BRIEFING WEBINAR SERIES

Our USFN complimentary Briefings allow you to stay in the know on breaking industry news, hot topics, and legislative updates. We know you have limited time in your schedule, so Briefings are one-hour live webinars and this year's lineup is keenly focused on subjects that are timely and most relevant to the mortgage servicing industry.

Webinars are open to all USFN members and client organizations including mortgage servicers, government-sponsored enterprises, banks, lenders, and other financial institutions involved in the servicing of defaulted loans. While Briefings will not be scheduled each month, we anticipate offering approximately six throughout the year. Be sure to register to gain actionable insights, solutions, and strategies to help your team tackle the most pressing issues facing our industry right now and succeed in today's ever-changing legal landscape.

YOU CAN'T HANDLE THE TRUTH: REAL-WORLD TRIAL & WITNESS PREP FOR SERVICERS

In this USFN Briefing, experienced practitioners bring trial and witness preparation to life through recorded role-play scenarios, real-time analysis, and candid discussion. You’ll watch firms conduct deposition and witness examinations, then pause to unpack why a response helped or hurt the case, what common mistakes servicers make, and how stronger preparation changes outcomes.

Designed for servicers who want the full spectrum — from depositions to trial testimony — this session explores the distinct roles of attorneys and witnesses, the purpose behind preparation, and how testimony is ultimately used after the fact. Whether you’re preparing a corporate representative, serving as a witness, or supporting litigation strategy, you’ll leave with clearer expectations, smarter preparation techniques, and practical insights you can apply immediately.

Session Outline:
  • The “Why” Behind Preparation: Understanding the purpose of depositions and trial testimony — and how preparation (or lack of it) directly impacts outcomes.
  • Roles Matter (Attorney vs. Witness Perspectives): How responsibilities differ when taking a deposition versus being deposed, including expectations for corporate and individual witnesses.
  • Pre-Deposition & Trial Prep That Holds Up: Preparing people and documents, avoiding shortcuts, and knowing when preparation is worth the investment.
  • In the Moment (Testimony Under Pressure): Techniques used to elicit— or rattle — testimony, how witnesses get impeached, and what helps versus hurts in real time.
  • Special Focus on 30(b)(6) Depositions: What it means to depose a corporation, how witnesses are designated, and common pitfalls servicers should anticipate.
  • Stop & Explain (Learning from Real Role Play): Breaking down good and less than optimal responses through recorded scenarios and expert commentary.
  • After the Testimony (How It’s Used Later): How deposition and trial testimony shows up downstream and how it can strengthen or weaken a case long after it’s given.
  • What Servicers Wish They’d Known Sooner: Recurring issues seen in practice and concrete ways to avoid them going forward.

You will be invited to provide questions for our panelists during the webinar. Questions may also be submitted during the registration process in the question box.
